Don't Panic — But Act Now

If you've overstayed your visa, every additional day adds to your penalty. The fine is 500 THB per day, capped at 20,000 THB. However, staying more than 90 days over carries a 1-year re-entry ban. Over 1 year means a 3-year ban. Self-reporting is ALWAYS better than being caught — penalties are much harsher if immigration finds you.

    Overstay Penalties Breakdown

1–90 days overstay: 500 THB/day fine (max 20,000 THB), no ban if you self-report. 90 days–1 year: 1-year re-entry ban. 1–3 years: 3-year ban. 3–5 years: 5-year ban. Over 5 years: 10-year ban. If caught by police or immigration (not self-reporting at the airport), add 1 additional year to any ban plus potential detention.

    Pattaya Immigration Office

Located on Soi 5, Jomtien (Soi Chaiyapruek). Open Monday–Friday, 8:30am–4:30pm, closed for lunch 12:00–1:00pm. Arrive early — by 7:30am if possible, as queues build quickly. Bring your passport, TM.6 departure card, 2 passport photos (4x6 cm), and the overstay fine amount in cash.

    Emergency Visa Extension

If you haven't overstayed yet but your visa expires soon, rush to immigration for a 30-day extension. Cost: 1,900 THB. You need: passport, TM.7 application form (available at immigration), 1 passport photo, and proof of accommodation. Extensions are usually same-day but can take 1–2 hours. Apply at least 1–7 days before expiry.

    Paying the Overstay Fine

If overstaying, you can pay at the immigration office or at the airport when departing. Cash only at the airport immigration counter. At the immigration office, bring exact change if possible. You'll receive a stamp in your passport noting the overstay. This doesn't prevent future entries if under 90 days and self-reported.

    Leaving Thailand with an Overstay

If your overstay is under 90 days, you can simply go to the airport and pay the fine at immigration before departure. Expect a 30–60 minute process. They'll stamp your passport and let you leave. For overstays over 90 days, you'll face a re-entry ban stamp. Budget extra time at the airport — arrive 4+ hours before your flight.

    Medical Emergency Extensions

If you overstayed due to a medical emergency (hospitalization, serious illness), bring your hospital documentation to immigration. Thai immigration can waive penalties for genuine medical emergencies. You'll need a letter from the hospital (in Thai), medical records, and proof of your condition. This is handled case-by-case.

    Legal Help for Serious Overstays

For overstays over 90 days, consider consulting an immigration lawyer before going to the immigration office. Thai immigration lawyers charge 5,000–20,000 THB and can negotiate on your behalf, prepare documentation, and potentially reduce bans. They can also help with voluntary departure procedures that minimize consequences.

    Visa Agents & Assistance

Licensed visa agents in Pattaya can help sort out overstay situations and emergency extensions. Costs range from 2,000–10,000 THB depending on complexity. They handle paperwork, translations, and accompany you to immigration. Find reputable agents through long-term expat recommendations — avoid street touts.

    Blacklist & Re-entry Bans

If you receive a re-entry ban, it starts from the date you leave Thailand. A 1-year ban means you cannot enter Thailand for 1 year from departure. Bans are strictly enforced — airlines check before boarding. There is no appeal process for overstay bans. The ban applies to all entry points including land borders.

    Frequently Asked Questions

Not bad at all if you act now. Your fine is 1,500 THB (500 THB x 3 days). Go to the airport or immigration office, pay the fine, and you're clear. Short overstays under 90 days with self-reporting carry no ban — just the daily fine. Your passport will get an overstay stamp, but this rarely causes issues for future Thai entries.

No. If you're already overstaying, leaving via a land border means paying the fine at the immigration checkpoint. You'll still get the overstay stamp and any applicable ban for stays over 90 days. There's no way to 'reset' an overstay — you must pay the fine regardless of how you exit.

A short overstay (under 7 days) rarely causes issues. Longer overstays (especially with a ban) will be flagged when you apply for future Thai visas. Some embassies ask about overstay history. For non-Thai visas, it generally doesn't affect other countries' applications, though it shows a pattern of visa non-compliance.

The fine is non-negotiable — 500 THB/day up to 20,000 THB. If you truly cannot pay, contact your embassy for emergency financial assistance. Some embassies can arrange emergency funds or repatriation. Do NOT continue overstaying to 'save up' — the penalties increase dramatically after 90 days with re-entry bans.

If you self-report (go to immigration or the airport voluntarily), detention is extremely unlikely for overstays under 90 days. If caught by police during a random check, you may be detained at the Immigration Detention Center (IDC) in Bangkok, which can last days to weeks while deportation is arranged. Self-reporting is always the better option.
