Don't Panic — But Act Now
If you've overstayed your visa, every additional day adds to your penalty. The fine is 500 THB per day, capped at 20,000 THB. However, staying more than 90 days over carries a 1-year re-entry ban. Over 1 year means a 3-year ban. Self-reporting is ALWAYS better than being caught — penalties are much harsher if immigration finds you.
Overstay Penalties Breakdown
1–90 days overstay: 500 THB/day fine (max 20,000 THB), no ban if you self-report. 90 days–1 year: 1-year re-entry ban. 1–3 years: 3-year ban. 3–5 years: 5-year ban. Over 5 years: 10-year ban. If caught by police or immigration (not self-reporting at the airport), add 1 additional year to any ban plus potential detention.
Pattaya Immigration Office
Located on Soi 5, Jomtien (Soi Chaiyapruek). Open Monday–Friday, 8:30am–4:30pm, closed for lunch 12:00–1:00pm. Arrive early — by 7:30am if possible, as queues build quickly. Bring your passport, TM.6 departure card, 2 passport photos (4x6 cm), and the overstay fine amount in cash.
Emergency Visa Extension
If you haven't overstayed yet but your visa expires soon, rush to immigration for a 30-day extension. Cost: 1,900 THB. You need: passport, TM.7 application form (available at immigration), 1 passport photo, and proof of accommodation. Extensions are usually same-day but can take 1–2 hours. Apply at least 1–7 days before expiry.
Paying the Overstay Fine
If overstaying, you can pay at the immigration office or at the airport when departing. Cash only at the airport immigration counter. At the immigration office, bring exact change if possible. You'll receive a stamp in your passport noting the overstay. This doesn't prevent future entries if under 90 days and self-reported.
Leaving Thailand with an Overstay
If your overstay is under 90 days, you can simply go to the airport and pay the fine at immigration before departure. Expect a 30–60 minute process. They'll stamp your passport and let you leave. For overstays over 90 days, you'll face a re-entry ban stamp. Budget extra time at the airport — arrive 4+ hours before your flight.
Medical Emergency Extensions
If you overstayed due to a medical emergency (hospitalization, serious illness), bring your hospital documentation to immigration. Thai immigration can waive penalties for genuine medical emergencies. You'll need a letter from the hospital (in Thai), medical records, and proof of your condition. This is handled case-by-case.
